TERMS OF SERVICE

You accept these Terms when you access the Service, create or connect an account, upload content, generate a video, or otherwise use any 4TOOLS feature. If you use the Service for a company, label, artist, or other organization, you represent that you are authorized to accept these Terms for that organization.

You must be at least 13 years old and meet TikTok’s minimum-age requirements in your country. If you are under the age of legal majority where you live, you may use the Service only with permission from a parent or legal guardian who agrees to these Terms.

When you sign in through TikTok, TikTok provides authorized account information that may include your display name, username, profile image, account statistics, and video information. You are responsible for your TikTok account, for keeping access to it secure, and for activity performed through your connected 4TOOLS account.

You may revoke 4TOOLS access through TikTok’s settings. We may require you to reconnect if an authorization expires or TikTok changes its requirements.

4TOOLS may allow you to upload WAV audio, create and download visualizer videos, connect a TikTok account, review permitted account or post metrics, compare performance signals, and receive automated creative recommendations.

Features may be released as previews or beta features. Certain functions may remain unavailable until TikTok approves the required developer products and permissions.

4TOOLS is an independent service and is not sponsored, endorsed, operated by, or affiliated with TikTok or ByteDance Ltd. TikTok is a third-party service governed by its own terms, privacy policies, platform rules, and developer requirements.

Our ability to provide TikTok-related features depends on the permissions and data TikTok makes available. TikTok may restrict, modify, delay, or discontinue access at any time. We do not control TikTok and are not responsible for its availability, decisions, data accuracy, account actions, or platform changes.

“User Content” means audio, music, artwork, titles, captions, links, account information, and other material you submit to or process through the Service. You retain ownership of your User Content.

You represent and warrant that you own your User Content or have all licenses, permissions, releases, and other rights needed to upload, process, reproduce, synchronize, edit, render, download, publish, and distribute it. You may not upload music, recordings, artwork, or other material you are not legally permitted to use.

4TOOLS does not clear samples, publishing rights, master rights, trademarks, publicity rights, or any other third-party rights for you. You are responsible for ensuring that your generated video and its publication comply with applicable law and the rules of every platform where you post it.

You grant 4TAKEOVER a limited, non-exclusive, worldwide, royalty-free license to host, copy, decode, crop, combine, render, transmit, and otherwise process User Content only as necessary to operate, secure, maintain, and improve the Service or fulfill your requests.

This permission does not transfer ownership of your User Content to us. Where video rendering occurs locally in your browser, your audio may remain on your device. Server-processed information may be retained as reasonably necessary to provide the Service, maintain account history, comply with law, prevent abuse, and enforce these Terms.

You may not use the Service to:

• Violate any law, regulation, court order, contractual obligation, or third-party right.
• Upload content you do not have permission to use or distribute.
• Impersonate another person, misrepresent ownership, or connect an account without authorization.
• Distribute malware, probe security, bypass access controls, scrape the Service, or interfere with its operation.
• Use automated systems to create excessive traffic or evade technical limits.
• Generate, promote, or distribute unlawful, fraudulent, deceptive, harassing, hateful, exploitative, or abusive material.
• Reverse engineer, resell, sublicense, or commercially reproduce the Service itself except as permitted by law or a separate written agreement.

You may use and distribute videos generated from User Content you are authorized to use, subject to these Terms and any rights in third-party templates, fonts, software, recordings, images, or platform elements.

Browser and device support may affect render time, frame rate, codec, file type, appearance, or download availability. You are responsible for reviewing every output before publishing it. Keep your own backup copies; 4TOOLS is not a permanent archive or backup service.

Analytics, scores, algorithm assessments, comparisons, and recommendations are informational estimates based on data available to 4TOOLS. They may be incomplete, delayed, illustrative, or affected by TikTok’s reporting methods and API limitations.

4TOOLS cannot determine TikTok’s private ranking decisions and does not guarantee views, followers, engagement, distribution, virality, revenue, or any other result. You are responsible for deciding whether to follow any recommendation.

The Service—including its software, interface, branding, layouts, templates, graphics, documentation, and original technology—is owned by or licensed to 4TAKEOVER and is protected by intellectual-property laws. Except for the limited right to use the Service under these Terms, no rights are granted to you.

“4TOOLS,” “4TAKEOVER,” and related branding may not be used in a way that suggests sponsorship or affiliation without prior written permission.

We may add, modify, limit, suspend, or discontinue any part of the Service. We may establish technical limits, maintenance periods, or usage restrictions. We do not promise that the Service will be uninterrupted, error-free, secure, or compatible with every device, browser, file, account, or third-party platform.

You may stop using the Service at any time and may revoke TikTok access through TikTok. We may restrict or terminate access if we reasonably believe you violated these Terms, created legal or security risk, infringed rights, abused the Service, or if a third-party platform requires us to do so.

Sections that by their nature should survive termination—including ownership, disclaimers, liability limits, indemnification, and dispute provisions—will remain effective.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” 4TAKEOVER DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.

Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 4TAKEOVER AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, CONTENT, GOODWILL, OPPORTUNITIES, OR BUSINESS INTERRUPTION ARISING FROM OR RELATED TO THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 4TAKEOVER’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID 4TAKEOVER FOR THE SERVICE DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR USD $100.

These limitations do not apply where prohibited by law.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless 4TAKEOVER and its owners, officers, employees, contractors, and affiliates from claims, losses, liabilities, damages, judgments, and reasonable legal expenses arising from your User Content, your use of the Service, your violation of these Terms, or your violation of another person’s rights.

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Unless applicable law requires otherwise, disputes relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Lancaster County, Pennsylvania, and you consent to their jurisdiction.

Before filing a formal claim, you and 4TAKEOVER agree to make a good-faith effort to resolve the dispute informally by written notice and at least 30 days of discussion.

We may update these Terms as the Service, law, or third-party requirements change. We will post the revised Terms and update the effective date. Material changes may also be presented through the Service. Continued use after updated Terms take effect constitutes acceptance where permitted by law.
